RewardBuy is committed to compliance with The Privacy Act 1988 and the Privacy Amendment (Private Sector) Act 2000. We understand the importance of following the National Privacy Principles outlined in the Privacy Act to ensure the privacy of your Personal Information. 2. Collection of information other than Personal Information

To maintain the integrity of the program we need to assess individual users’ eligibity for access to Exclusive Rewards. To do so requires Your Association provide a unique identifier for each eligible user which may be cross-checked against one piece of information they may hold for you. However, your identity can not reasonably be ascertained from this information, so RewardBuy does not hold any of your Personal Information that you have not voluntarily provided. 

5. Security

No data transmission over the internet can be entirely secure, and therefore we cannot guarantee the security of your Personal Information and/or use of our Website. RewardBuy will therefore not be responsible for any breach of security or unintended loss or disclosure of information that is passed to it via the internet. However, RewardBuy has taken all appropriate measures to prevent unauthorised access, improper use, and inaccuracy of your Personal Information. All data is kept in a secure environment and when your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. RewardBuy enters into agreements with commercial partners whose websites may be co-branded and which you may visit directly through our Website. These websites are not subject to our privacy policy. You are advised to read the privacy policy of these websites.

RewardBuy may without notice change, modify or withdraw access to the Website, or the content of these pages at any time. The materials presented here are summary in nature and subject to change. The Exclusive Rewards website (hereinafter "the Website") is operated by RewardBuy Pty Ltd ABN 51 161 668 337 on behalf of Your Association. For the purposes of the Terms and Conditions, the terms "we," "us," "our," and "RewardBuy", refer to RewardBuy Pty Ltd and its Affiliates and Brands including Exclusive Rewards. "You" refers to you, as a user of the Website. "Participating Retailer" refers to those retailers or service providers listed on the Website.

These Terms and Conditions ("the Terms") govern your use of Exclusive Rewards (also referred to as "the program"). The program includes offers that are listed on the Website and on any associated communication, including but not limited to emails, printed brochures or other collateral. 

Please read through the Terms. By using this Website, you expressly signify your agreement to these terms and conditions, including all changes and revisions to the Terms. If you do not agree to these terms and conditions, then please do not use the Website.

RewardBuy reserves the right to revise the terms and conditions. As a condition of your use of the Website, you agree to carefully and periodically check the terms for revisions and amendments. Any revision or amendment will be effective immediately upon posting to the Website and your continued use of the services provided by RewardBuy, subsequent to the posting of any revisions or amendment, constitutes your acceptance of such revisions and amendments. 

RewardBuy reserves the right to refuse, restrict, suspend, or terminate any user's access to the Website at any time without notice if a user fails to abide by the terms. RewardBuy also reserves the right to take such other action as is reasonably necessary to protect our business and that of third parties if a user fails to abide by the terms.

1. Conditions of use of the Website

Exclusive Rewards is a member benefit program which includes access to discounts, offers and benefits from Participating Retailers as listed on the Website. 

You agree that the use of the Website is undertaken at your own risk. No warranties are made by RewardBuy, its agents, employees, shareholders, officers or directors that the Website will operate error-free or without interruption. The Website and its content are presented "as is".The information contained in the material on the Website is for information purposes only. No warranties, express or implied, are made as to the accuracy of the information on the Website. 

RewardBuy is not responsible for any direct or indirect damages of any kind, including but not limited to any injury, loss, claim, loss of business, expenses, loss of data, loss of revenue, loss of profits or any special, exemplary, punitive, incidental or consequential damages of any kind, arising from the use or inability to use the Website.

No warranties are made about the products or services offered by any Participating Retailer on the Website. Furthermore, by listing a service, product or discount, RewardBuy is not endorsing, recommending or sponsoring any product or service of any Participating Retailer. Any and all transactions are between you and the retailer. RewardBuy is not a party to any transaction, and thus, you should take due diligence in investigating, selecting and transacting with any retailer listed on the Website. You are knowingly and voluntarily assuming all risks of using any retailer to purchase goods and services and of using any coupons or discounts listed on the Website. You agree that RewardBuy shall have no liability whatsoever for any such third party transaction. If you do have any concerns about the offers or retailers represented on the Website, please contact us to discuss.

The Website contains material submitted and created by third parties including but not limited to Your Association and Participating Retailers. RewardBuy takes no responsibility for such material and is not liable for any illegality arising from or error, omission or inaccuracy in such material. 

2. Your access

You must be a current member of Your Association to access the Website. Your Association may also apply terms and conditions to your use of the program. These terms and conditions will be advised prior to you registering for the program and will be available on Your Association's website. 

RewardBuy reserves the right to terminate any user's access immediately and without notice if they are no longer a member of Your Association. In this instance, any Personal Information we may hold for the user will be securely disposed of in accordance with our Privacy Policy.

RewardBuy reserves the right to refuse, restrict, suspend, or terminate any user's access if they are deemed, at our sole discretion, to be attempting to misuse the program. RewardBuy reserves the right to suspend, or terminate any user's access if they do not visit the Website for a period of 12 months or more. 

RewardBuy provides you with the information and services on the Website for your own personal use. You are not entitled to distribute the information on the Website for any purpose.

You must not directly or indirectly, use the Website to resell, resupply or otherwise derive income from the Website. You must not reverse engineer or in any other way access or utilise any software that we provide you in connection with the Website other than for the purpose for which the program is expressly provided.

You must not impede our ability to provide the service or prevent others from using or receiving the full benefit from the Website. The material appearing on the Website are the property of the Participating Retailers, organisations, and businesses in the RewardBuy program and may not be reproduced, downloaded, disseminated, displayed, published, or transferred in any form or by any means, except with the prior written permission of RewardBuy, or as indicated below. 

As a user, you may download pages or other content for your own personal, non-commercial use. However, no part of such content may be otherwise or subsequently reproduced, downloaded, disseminated, displayed, published, or transferred, in any form or by any means, except with the prior written permission of RewardBuy.

You may not "cache" any material for access by third parties or "mirror" any material on the Website. You may not provide a link to the Website from any other website without first obtaining prior written consent from RewardBuy.

4. Indemnity

The material on the Website does not constitute advice and you should not rely on any material on the Website to make (or refrain from making) any decision or take (or refrain from taking) any action.

RewardBuy makes no warranty that the Website (or websites which are linked to this website); its servers or email sent from RewardBuy is free from computer viruses or any other malicious or impairing computer program or that the functions contained in the Website will be uninterrupted or error free. 

RewardBuy will endeavour to ensure the information on the Website is accurate and reserves the right to make changes to the Website and our policies at any time without notice. All offers and Participating Retailers are subject to change and we reserve the right to add or remove retailers and change or withdraw offers. RewardBuy may suspend or terminate all or part of the program with or without notice without incurring any liability to you.

You agree to indemnify RewardBuy and its employees, contractors, retailers, clients, managers, officers, shareholders, agents and directors from all liabilities, claims, losses, damages, obligations, costs, and expenses that arise from or relate to (a) your use of and access to the Website or any services, information or products from the Website; (b) your inability to use the Website; (c)your use of any third party websites; (d)the inaccuracy or incompleteness of any information supplied through the Website; (e) your violation or breach of any of these terms and conditions, or your representations and warranties; or (f) your violation of the rights of any third party, including but not limited to any copyright, property, or privacy right. In the event of a problem with the product or service that has been ordered all queries should be directed to the retailer concerned.

When you register to use the Website, you will automatically be subscribed to receive email updates from RewardBuy. These email updates may include information about new offers and new retailers which we think you may be interested in.

If you do not wish to receive email updates or other promotional emails, you may unsubscribe at any time by simply following the instructions contained in the particular communication. Opting out will permanently remove your email address and exclude you from receiving future notification of additional benefits, services, and discount offers.
